Noctiq Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Stylianos Sapalidis ("Noctiq", "we", "us") governing your use of the Noctiq: Sleep Coach app and related services (the "Service"). By downloading, accessing, or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

The Service

Noctiq provides general sleep and wellness tracking, education, AI-assisted coaching, routines, reminders, widgets, and optional community features. Noctiq is not a medical device, healthcare provider, diagnostic service, or a substitute for professional medical advice, diagnosis, or treatment.

Do not use Noctiq for emergencies. If you think you may have a medical emergency, call your local emergency number. Seek advice from a qualified clinician for persistent symptoms, suspected sleep apnea, or before making health, supplement, or medication decisions. AI-generated coaching is general wellness information and may be incomplete or inaccurate; you are responsible for decisions you make.

Eligibility and your account

You must be at least 16 years old (or the minimum age of digital consent in your country). You agree to provide accurate account information, to keep your account credentials secure, and to be responsible for activity under your account. You may sign in with Apple, with email, or continue with a limited anonymous session where offered.

Acceptable use

You agree not to:

  • use the Service unlawfully or in violation of these Terms;
  • post or share content that is abusive, harassing, hateful, dangerous, misleading, infringing, or unlawful;
  • harass, threaten, or harm other users;
  • attempt to access accounts, data, or systems without authorization, or to disrupt, reverse engineer, or circumvent the Service or its security;
  • use the Service to provide medical advice to others or to misrepresent Noctiq output as medical advice.

We may moderate, hide, or remove content, and suspend or terminate accounts, that we reasonably believe violate these Terms or harm users or the Service. Community posts may be held pending automated moderation before becoming visible.

Subscriptions, billing, and cancellation

Noctiq offers auto-renewable subscriptions ("Noctiq Pro") that unlock premium features. A free trial may be offered; if you do not cancel before the trial ends, the subscription begins and you are charged.

  • Purchases are processed by Apple through your Apple ID. Pricing, subscription period, trial duration, and renewal terms shown at the point of purchase control.
  • Subscriptions renew automatically until cancelled. You can manage or cancel a subscription in your Apple ID subscription settings; cancellation takes effect at the end of the current billing period.
  • Refunds are handled by Apple in accordance with the App Store's policies. We do not separately process App Store payments or issue App Store refunds.

Third-party services

The Service integrates third-party services, including Apple, Supabase, RevenueCat, and Google (Gemini). These services may be unavailable, change, or return incomplete or inaccurate results, and your use of connected accounts is also subject to those providers' own terms. We are not responsible for third-party services.

Intellectual property

The Service, including its software, content, and branding, is owned by Noctiq or its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use, subject to these Terms. You retain rights to content you submit, and you grant us a license to host, process, and display that content solely to operate and provide the Service (including moderation and community display where applicable).

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that results (including sleep scores and coaching) will be accurate or reliable.

Limitation of liability

To the maximum extent permitted by law, Noctiq will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law, including certain consumer rights.

Termination

You may stop using the Service and delete your account at any time in Settings → Data & Privacy. We may suspend or terminate access if you violate these Terms or to protect users or the Service. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute terms) will survive.

Changes to the Service and to these Terms

We may modify the Service and update these Terms from time to time. For material changes we will update the effective date and provide notice in the app. Continued use after changes take effect constitutes acceptance.

Governing law and disputes

These Terms are governed by the laws of Greece, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights available to you in your country of residence. You and Noctiq agree to attempt to resolve disputes informally first by contacting support@trypadelup.com.

Consumer rights

If you are a consumer in the EU/EEA, UK, or another jurisdiction with mandatory consumer-protection laws, those rights are not affected by these Terms, and any conflicting provision applies only to the extent permitted by such laws.
